The car can stay in your name in Spain

This is the single biggest danger, and most people selling a Spanish car in the UK have no idea it exists. When you sell a Spanish-registered vehicle, it isn't enough to simply hand over the keys and take the money. The vehicle must be formally deregistered or transferred in Spain — a process known as the baja or transferencia.

If that step isn't completed correctly, then as far as the Spanish authorities are concerned you are still the legal owner. The car remains on the Spanish register under your name — even though it's sitting on someone else's driveway, or has been scrapped, exported or resold.

What that actually means for you

While the car is still in your name, you remain liable for everything attached to it in Spain: the annual road tax (IVTM), any parking or traffic fines the new keeper racks up, ITV (MOT) penalties, and even charges if the car is later abandoned or involved in an incident. These can accumulate for years — and Spanish authorities can and do pursue the registered owner for unpaid amounts.

The danger almost always comes down to who you sell to. Sell privately or to an unregistered "we'll take it off your hands" buyer, and there's no guarantee the deregistration ever happens. Once they've got the car, they have little incentive to file the Spanish paperwork properly — and it's your name, not theirs, left exposed on the register.

By the time the fines and tax demands appear, the buyer is long gone and untraceable, and you're left trying to prove you no longer own a vehicle you sold months or years ago — from another country, in another language.
